Your Agreed to Terms, Conditions & Policies

The following Terms, Conditions, Policies and so on apply to your use of DoggieWasteStations.com (our “Site”)  and any products or services offered at our Site.  Your use of our Site means that you accept and agree to everything on our Site which also includes but not limited to every time you call, email, text, purchase and so on.  If you do not agree to  this, please do not use or access the Site, place orders and so on.  We revise and update from time to time which is at our sole discretion. Your continued use of our Site and Communications of any kind via any platform, means that you accept and agree to the modified Terms as notification is not required and is your sole responsibility to visit frequently.  Furthermore, you have also agreed that you have read all Terms, Conditions, Policies, Product Details and so on prior to any purchase and therefore know and agree to everything.

Custom Orders and Products are made from scratch, made to order and can not be returned and can not be cancelled at any point in time or at any point in production stage for any reason.  All sales are final.  All rights reserved.  Subject to change and/or availability.  Please note that this is your acknowledgment and agreement. 

Since shipping carriers give anywhere from 5 to 7 Days to File a claim on your behalf,  you are required to immediately notify us in writing via email only within 2 Days of the Delivery Date that the product has not arrived, is lost, damaged and/or stolen.  The email must include your Order #, Full Billing Name, Address and Phone# as well as the Full Ship To Name, Address and Phone #.   Please note that each carrier i.e. FedEx, UPS, USPS, and so have different response times which we have no control over but usually take about 7-10 business day and is not a guarantee.  If you fail to do this, you agree that we are not responsible for product that is lost, stolen or damaged and release us of any and all liability thereof.  As such, you also agree not to dispute the charge for any reason as this also your acknowledgement and agreement.  Please note there is a $50 Processing Fee + 3.5% Transaction Processing Fee per Dispute.

All product must be new, unused and in original resellable packaging.  You must notify us in writing via email only within 5 Days of the Delivery Date.  The email must include a picture of all product,  your Order #, Full Billing Name, Address and Phone# as well as the Full Ship To Name, Address and Phone #.  There is a 25% Restocking Fee + the Return Shipping Label Cost in which both will be deducted from your Refund.  All sales on custom products are final.  No exceptions. 

DoggieWasteStations.com (Seller) shall make good by replacement or, by mutual agreement between Seller and the Customer, repair any failure (fair wear and tear, paint fading, salt corrosion, vandalism, improper use or improper installation, excepted) in a dog waste station, dispenser, can or sign which, under conditions of proper use and maintenance, results from defects in the Seller's manufacture, design, materials or workmanship for 2 years from the date of purchase from Seller. The Seller's liability under this Condition shall automatically cease if: The Customer shall not have paid for all Goods supplied provided under any contract by the due date or is otherwise in breach of this or any other contract made with the Seller or, The Seller or its servants or agents are denied full and free right of access to the allegedly defective Goods or the Customer has not properly maintained the Goods or, the defect or failure is caused by willful damage, neglect, misuse, improper installation, accident or abnormal working conditions, or damage caused by landscaping, irrigation systems, pesticides, chemicals, salt water, severe storms or high winds, or continued use after a defect has become apparent or, the Customer is no longer the owner of the Goods or, the Customer has failed to notify the Seller in writing of any defect or suspected defect within 30 days of the same coming to the knowledge of the Customer or, if such defect or failure arises as a result of any inaccurate or incomplete information or details supplied by the Customer or, in any defect or inaccuracy in any operating conditions, equipment or other property of the Customer. 

THE WARRANTY SET OUT HEREIN SHALL BE IN LIEU OF ANY WARRANTIES CONDITIONS OR UNDERTAKING WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR OTHERWISE HOWSOEVER WHICH WARRANTIES, CONDITIONS AND UNDERTAKINGS ARE HEREBY EXPRESSLY EXCLUDED, EXCEPT THAT SUCH EXCLUSIONS WILL NOT APPLY. THE SELLER'S RESPONSIBILITY IS LIMITED TO THE TERMS OF THE FOREGOING PROVISIONS OF THIS CONDITION AND (EXCEPT IN RESPECT OF DEATH OR PERSONAL INJURY RESULTING FROM THE NEGLIGENCE OF THE SELLER, ITS SERVANTS OR AGENTS). THE SELLER SHALL NOT BE LIABLE FOR ANY CLAIM FOR DIRECT OR INDIRECT CONSEQUENTIAL OR INCIDENTAL LOSS, INJURY OR DAMAGE WHATSOEVER (INCLUDING, BUT NOT LIMITED TO LOSS OF PROFIT) MADE BY THE CUSTOMER OR ANY THIRD PARTY AGAINST THE SELLER ARISING OUT OF OR IN CONNECTION WITH ANY DEFECT IN THE GOODS AND/OR SERVICES WHETHER OR NOT SUCH DEFECT IS DIRECTLY OR INDIRECTLY WHOLLY OR IN PART CAUSED BY THE ACT, OMISSION, DEFAULT OR NEGLIGENCE OF THE SELLER, ITS SERVANTS OR AGENTS AND WHETHER OR NOT SUCH DEFECT AMOUNTS TO A BREACH OF A FUNDAMENTAL TERM OR A PRIMARY OBLIGATION OF THE CONTRACT OR A FUNDAMENTAL BREACH THEREOF.
